Prenuptial agreements are becoming more popular as an increasing number of divorces are ending in the unfair distribution of assets, and the process being drawn out for great lengths of time due to disagreements over how assets should be split.
The courts are now also taking a much greater consideration of prenuptial agreements in divorce cases.
Although a “prenup” might not seem a particularly romantic thing to consider when you are planning to marry it is often the best way to be totally clear from the outset as to how a couple’s assets should be divided in the unfortunate event of a divorce. In the long run, prenuptial agreements can save a lot of time and money.
Prenuptial agreements are not yet legally binding but recent Case Law has demonstrated that the Courts are placing a growing importance in them. It is therefore highly recommended that a couple consider making one so that the agreement over the distribution of assets is as straightforward as it possibly can be should the relationship break down.
Both parties need to obtain independent legal advice and a full and frank disclosure of all assets that each person has should be exchanged. Following this an agreement would be formed that both parties consider to be fair.
Forbes Family Solicitors have acted on many cases where a couple has wanted to put together a prenuptial agreement before marriage, and can advise on the fairest way of splitting appropriate assets in such a way. However if you failed to set up a prenuptial agreement and are now going through a divorce, we can also advise on how best to get everything you are entitled to.
