Process Serving

Important legal documents, in particular most claim forms or applications, must be served personally or in accordance with fixed Court rules. There are also circumstances in which, whilst the Court rules do not require personal service, it is highly advisable to effect personal service because the Defendant is likely to allege they did not receive documents if served via first class post as a general avoidance or delaying tactic to defend the claim.

Common circumstances where we are instructed for process serving are for service of :=

Process serving may appear (and sometimes is) straightforward. However, adherence to the rules of the Court is paramount, in particular where an application for deemed service subsequently needs to be made. There are also many occasions where the individual(s) to be served will actively seek to evade service.
