{"id":5401,"date":"2020-07-14T11:13:45","date_gmt":"2020-07-14T10:13:45","guid":{"rendered":"https:\/\/www.infolaw.co.uk\/newsletter\/?p=5401"},"modified":"2021-01-05T11:42:32","modified_gmt":"2021-01-05T11:42:32","slug":"a-digital-tax-trade-war","status":"publish","type":"post","link":"https:\/\/www.infolaw.co.uk\/newsletter\/2020\/07\/a-digital-tax-trade-war\/","title":{"rendered":"A digital tax trade war?"},"content":{"rendered":"\n<p>We previously <a href=\"https:\/\/www.infolaw.co.uk\/newsletter\/2019\/09\/new-digital-services-tax-implemented-france\/\">reported<\/a> on a controversial digital services tax (also known as the GAFA tax) which was implemented in France towards the end of 2019, which levies a 3 per cent tax on digital services gross revenue (as opposed to profits) made in France by companies with total worldwide revenues of more than \u20ac750 million \u2013 of which at least \u20ac25 million is generated in France. The aim is to close the tax loopholes which effectively allow large technology firms to avoid paying tax by basing their regional headquarters in tax havens.<\/p>\n\n\n\n<p>Around the same time, the Organisation for Economic Co-operation and Development (OECD) announced <a href=\"https:\/\/www.oecd.org\/tax\/oecd-leading-multilateral-efforts-to-address-tax-challenges-from-digitalisation-of-the-economy.htm\">proposals<\/a> to introduce a similar taxation scheme which would cover all highly profitable multinationals \u2013 not just digital services companies &#8211; on a global scale. The aim is essentially the same as with the French GAFA tax \u2013 to ensure that large corporations \u201cpay tax wherever they have significant consumer-facing activities and generate their profits.\u201d Although it wasn\u2019t billed as a plan to specifically target digital companies, in practice this would hit the tech giants which inspired the name \u201cGAFA tax\u201d (Google, Apple, Facebook, Amazon) particularly hard.<\/p>\n\n\n\n<p>Speaking at the time the proposals were published, OECD Secretary-General Angel Gurr\u00eda said that: \u201cWe\u2019re making real progress to address the tax challenges arising from digitalisation of the economy, and to continue advancing toward a consensus-based solution to overhaul the rules-based international tax system by 2020.\u201d He also issued a stark warning: \u201cFailure to reach agreement by 2020 would greatly increase the risk that countries will act unilaterally, with negative consequences on an already fragile global economy.\u201d<\/p>\n\n\n\n<p>Since then, the UK has introduced its own <a href=\"https:\/\/www.gov.uk\/government\/publications\/introduction-of-the-digital-services-tax\/digital-services-tax\">digital services tax<\/a> which will be applicable to any revenue earned from 1st April 2020 (although the relevant legislation, <a href=\"https:\/\/www.gov.uk\/government\/publications\/finance-bill-2020-legislation-and-explanatory-notes\">The Finance Bill 2020<\/a>, has not yet been enacted).
